Welcome to SAPPHIRE360. Please read these Terms and Conditions carefully before using our platform. By accessing or using our services, you agree to be bound by these Terms and Conditions.

These Terms and Conditions govern your use of SAPPHIRE360, an advanced analytics platform designed for real-time personalized engagement across multiple communication channels. By using our platform, you agree to comply with these terms and any applicable laws and regulations.
2. Account Registration
To access our services, you must register for an account. You agree to provide accurate, current, and complete information during the registration process and to update such information to keep it accurate, current, and complete. You are responsible for safeguarding your account credentials and for any activities or actions under your account.
3. Use of the Platform
You agree to use SAPPHIRE360 only for lawful purposes and in a way that does not infringe the rights of, restrict, or inhibit anyone else's use and enjoyment of the platform. Prohibited activities include harassing or causing distress or inconvenience to any person, transmitting obscene or offensive content, or disrupting the normal flow of dialogue within our services.
4. Distribution Lists and Audiences
4.1 Creating Distribution Lists and Audiences
You can create distribution lists and audiences by importing contacts via CSV files or directly from your email client. Your distribution lists and audiences are stored securely on our servers.
4.2 Data Security and Privacy
We do not sell your distribution lists or audiences under any circumstances. Only authorized employees have access to view your lists and audiences. You may export (download) your lists and audiences at any time.
4.3 Use and Disclosure of Information
We use and disclose the information in your distribution lists and audiences solely for the purposes discussed in sections 6-9 of these terms. We do not use this information for billing, sending system alerts, communicating about your account, or sending promotional content. If we detect abusive or illegal behavior related to your lists or audiences, we may share this information with affected ISPs or anti-spam organizations.
5. Content
You are responsible for the content you upload, post, or otherwise make available through SAPPHIRE360. You agree not to upload, post, or otherwise make available any content that is unlawful, harmful, threatening, abusive, harassing, defamatory, vulgar, obscene, or invasive of another's privacy.
6. Intellectual Property
All content, trademarks, and data on this platform, including software, databases, text, graphics, icons, and hyperlinks are the property of or licensed to SAPPHIRE360 and as such are protected from infringement by local and international legislation and treaties. You agree not to reproduce, duplicate, copy, sell, resell, or exploit any portion of the service without express written permission by us.
7. Payment and Fees
By creating an account and using our services, you agree to pay all applicable fees and charges. We reserve the right to change our fees at any time, with notice provided to you in advance.
8. Termination
We reserve the right to suspend or terminate your account and your access to our services at our sole discretion, without notice, if you violate these Terms and Conditions or engage in any conduct that we deem inappropriate or unlawful.
9. Limitation of Liability
To the fullest extent permitted by law, SAPPHIRE360 shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly, or any loss of data, use, goodwill, or other intangible losses, resulting from (a) your use or inability to use the platform; (b) any unauthorized access to or use of our servers and/or any personal information stored therein; (c) any interruption or cessation of transmission to or from the platform; (d) any bugs, viruses, trojan horses, or the like that may be transmitted to or through our platform by any third party; (e) any errors or omissions in any content or for any loss or damage incurred as a result of the use of any content posted, emailed, transmitted, or otherwise made available through the platform; and/or (f) the defamatory, offensive, or illegal conduct of any third party.
10. Governing Law
These Terms and Conditions shall be governed by and construed in accordance with the laws of the jurisdiction in which SAPPHIRE360 operates, without regard to its conflict of law principles.
11. Changes to Terms
We reserve the right, at our sole discretion, to modify or replace these Terms and Conditions at any time. If a revision is material, we will provide at least 30 days' notice prior to any new terms taking effect. What constitutes a material change will be determined at our sole discretion.
